Federal High Court Rejects Ex Parte Bid to Transfer Nnamdi Kanu

The Federal High Court in Abuja has turned down an ex parte application filed on behalf of IPOB leader Nnamdi Kanu, who sought to be moved from the Sokoto Correctional Centre to a custodial facility closer to the Federal Capital Territory.

Kanu, represented by the Legal Aid Council, asked the court to order the Federal Government or the Nigerian Correctional Service to relocate him to either the Kuje Custodial Centre in Abuja or the Keffi facility in Nasarawa State. He argued that a transfer would enable him to properly pursue his ongoing appeal.

He also requested, in the alternative, to be moved to any correctional facility within the court’s jurisdiction, including Suleja or Keffi, to ensure easier access to legal counsel and the court.


Justice James Omotosho declined the request during Monday’s sitting, ruling that the relief sought could not be granted without hearing from the Federal Government. The judge held that issuing such an order ex parte would not satisfy the requirement of fair hearing.

He directed Kanu to convert the application into a motion on notice and serve all relevant parties.


The court scheduled January 27, 2026, for the hearing of the motion once all parties have been properly notified.


The decision leaves Kanu in the Sokoto facility for now, while the court prepares to reconsider the transfer request through a full hearing next year.
